Employees at the Goodwill store in Johnson City, TN, operated within Tennessee state law when they asked for documentation of a service dog. Since 2001, Tennessee law has allowed stores and facilities to request documentation of a service animal as part of the Americans with Disabilities Act. http://www.tn.gov/attorneygeneral/op/2001/op/op156.pdf Goodwill of the Tenneva Area’s current policy is that they will not ask for documentation of a service animal, which is permitted by Tennessee law. We will instead follow the broader federal Americans with Disabilities Act, which allows store employees to ask a store guest if any animal present is a service animal required because of a disability and about the service or task the animal has been trained to perform. According to the ADA, both of these questions are legal to ask whenever an animal enters a facility. We encourage all people with disabilities to take advantage of Goodwill’s job training programs to help them build their careers, and shop and donate at our stores with their service animals. Goodwill is the leading nonprofit provider of job training and community-based services for people facing challenges to finding employment including people with disabilities and disadvantages, such as a lack education or work experience. |
